SECTION 20 AND ALL THAT.... (PART 2)

Interestingly, the circumstances relating to the use of intermediate/head leases are becoming even more common as a result of social housing provision and the granting of such leases to registered social landlords (RSLs). In particular, it is important to note that a landlord or superior landlord is required to consult with all parties to the property leases and that includes not only the occupational leaseholders, but any head lessee or under lessee in respect of the common parts as well as th...

WHAT DOES IT REALLY COST TO MANAGE?

"Well certainly there is significant pressure to meet artificial targets above which developers believe there will be sales resistance. To some extent this is driven by the rates at which other local Schemes are being charged, and to a further extent, by the number of investors looking for a return on their investment."

The downside of this is that the estimated cost of services for many Schemes are either inaccurate, or have been trimmed in areas which will have a detrimental effe...

SMOKE FREE REGULATIONS!

As it is now against the law not to display the relevant signage, Landlords (or their agents) have to display no-smoking signs that meet the requirement of the Regulations to comply. It applies equally whether the development has site staff or not.

External porches, if less than 50% open sided, are also to be smoke-free zones; this would also apply to any external smokers shelters. If an office has been provided, within a block, for a member of staff such as a porter, or if there are rooms...

BEWARE SECTION 20 AND ALL THAT....

We believe that if you enter into an agreement for, say, 10 years before any tenants occupy, then when the tenants arrive they can refuse to pay for that service if the cost is greater than the £100 per annum limit per unit if they are minded to do so. It is important to remember that where there are service charge costs that vary with apartment floor areas, then only one apartment has to be over the limit for the legislation to kick in.
